Why does the job exist?
Incumbent will provide advanced level professional legal services for protective services cases in context of litigation and providing counsel, interpretation of law, research and legal analysis to Protective Services staff in the region to which the attorney is assigned. Incumbent is responsible for assisting other Children's Court Attorneys in complex or high profile cases and/or assuming responsibility for such cases throughout the region.
How does it get done?
- Prepare cases for trial and provide quality representation for agency at trials, hearings, and mandatory meetings in accordance with the Protective Services Division practices.
- Secure Termination of Parental Rights (TPR) on cases where child¿s plan is adoption and permanent guardianship in accordance with plan.
- File and prosecute abuse/neglect and FINS actions in accordance with time frames and standards set forth in the Children¿s Code, Rules, policy and procedure and ASFA (Adoption and Safe Families Act.
- Maintain and improve professional relationships with the court, Guardian Ad Litems, respondents¿ attorneys, Court Appointed Special Advocates, Citizen Review Boards, social workers and work to improve the system.
Minimum Qualification
Juris Doctorate degree from an accredited school of law and four (4) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Background investigation is required and is conditional pending results.
Working Conditions
State of New Mexico employees may be impacted by the Public Health Order dated December 19, 2022, which requires facilities licensed or certified by the Centers for Medicare and Medicaid Services ("CMS"), including all hospital types, long-term care facilities, nursing homes, hospice facilities and rehabilitation facilities, as well as assisted living facilities and adult day care settings, to adhere to all COVID-related requirements prescribed by CMS, including, but not limited to masking and staff vaccination.
Work is performed in an office setting with exposure to Visual/Video Display Terminal (VDT) and extensive personal computer and phone usage. Incumbent will work under stress and frequent time constraints. May be exposed to potentially difficult clients/witnesses. Some statewide travel may be required. Must have own mode of transportation for daily travel.
